TERMS AND CONDITIONS

The following Terms and Conditions apply to all bookings made on this website. We kindly ask that you take a moment to read them prior to making a Booking as you will be bound by them.

Definitions

In these Terms and Conditions the following definitions apply:

“Company” or “we” means Musang Lena (Company Regsistration No. 001869770-K) whose registered address is 32 Jalan 1/80B, Bangsar Ria, Bukit Bandaraya, 59100 Kuala Lumpur, Malaysia)

“Booking” means the booking for accommodation made with us

“Contract” means the Booking and these Terms, and any other terms and conditions stated to apply to the Booking.

“Guesthouse” means 45Lekiu, the premise for which your Booking is made.

“Terms” means these terms and conditions.

“Website” means www.45lekiu.com or any other website owned or operated by us relating to a Guesthouse from time to time.

General

Your contract is with Musang Lena; which operates 45Lekiu; and its associates, subsidiaries and affiliates.

The general Terms and Conditions herein together with the Fee Schedule and Hotel Schedule (together “these Terms and Conditions”) and the Booking Confirmations constitute your contract with Musang Lena and are further supplemented by the internal rules and regulations that apply specifically to 45Lekiu where you have booked your stay.

Bookings

Bookings may be made online at www.45lekiu.com , through our authorized booking agents or by calling Musang Lena directly.

Prepayment for the full duration of your stay is required at the time of booking. We accept payment by Visa or MasterCard credit/debit cards, PayPal, iPay88 or online bank transfer. The available options are displayed during the booking process. For walk-in bookings, we also accept cash payment.

Once your booking has been successfully completed, a Booking Confirmation will be issued and sent to the email address provided in your registered account. If you do not receive your Booking Confirmation(s) within 24 hours from the time of booking, please contact us immediately.

During the booking process, you are advised to ensure the accuracy of your booking details – stay dates, room rates, number of guest(s). Musang Lena will not be responsible or liable for errors in bookings.

Bookings are accepted subject to room availability.

Guesthouse Rates

Rates shown on this website are charged on a per guesthouse per night basis, inclusive of service tax and service charges. Breakfast is included.

Rates and details are correct at the time of publications and are subject to change without notice.

Restrictions

In the interest of security and for insurance purposes, the Guesthouse is subject to maximum occupancy rule of 4 persons and all guests staying at the Guesthouse are required to be registered. Musang Lena reserves the right to remove or ask the unregistered guest(s) to leave the Guesthouse immediately if we shall, in our sole opinion, deem that you have violated this rule.

You may not bring the following into 45Lekiu:
– Pets (except for registered guide dogs) or livestock
– Pillows, bed sheets, duvets or other items of bedding
– Any electrical appliances, barbeque and/or equipment for heating and/or cooking purposes.

Musang Lena reserves the right to remove and/or confiscate any of the above items found in the Guesthouse immediately without notice to you and to charge you for any costs incurred for taking such action

Musang Lena further reserves the right to ask you to leave the Guesthouse and remove your belongings immediately if we shall, in our sole opinion, deem that you have used the guesthouse in an irresponsible manner or in a manner that will compromise the safety of, or cause damage and/or harm to the Guesthouse, the premise, the staff or any other persons or the reputation of Musang Lena without any compensation and/or any reimbursement to you.

Check-In and Check-Out

45Lekiu operate a strict Check-In Check-Out policy.

Unless otherwise agree upon, guests may Check-In at any time from 1500hr on the scheduled day of arrival. Bookings will be held until 2359hr on the scheduled day of arrival unless otherwise agreed directly with us. Any non-secured reservation will be held until 1600hr on the day of arrival at which time we will be entitled to re-let the Guesthouse, unless the guest has notified us of a late arrival.

On the day of departure we kindly ask all guests to vacate the Guesthouse by 1100hr (unless a later departure has been agreed upon with the Guesthouse). If you Check-Out beyond the stipulated time, we reserves the right, without further notice to you, to charge you an additional one (1) night’s stay at the then prevailing rate or remove your belongings into the luggage and deny you further access into the Guesthouse. Musang Lena shall not be liable for any loss or damage to your belongings as a result fo the action(s) taken.

Cancellations Policy and No Shows

The full 100% of the prepayment amount will be refunded in the event of cancellation 21 days prior to the scheduled arrival.

For cancellation less than 21 days notifications, only 50% of the amount paid will be refunded.

Any cancellation made less than 7 days from the scheduled Check-In date will result in the total payment under that Booking Confirmation being forfeited irrespective of the number of stay dates remaining.

Damages

We reserve the right and you hereby authorize us to charge your credit or debit card for any damage incurred the Guesthouse during your stay (including without limitation specialist cleaning) or for any items that are missing when you leave.

Smoking

Smoking is prohibited in any part of the Guesthouse except in any restricted smoking area(s) designated by Musang Lena.

Swimming Pool

Guests staying at 45Lekiu may use the swimming pool at their own risk. Children under 16 years of age must be accompanied by an adult at all times when using the swimming pool. Musang Lena cannot and do not assume liability in the event that any death, injury, health issue or damages of any nature arises as a result of the use of the swimming pool facilities.

Children

All children (a person under 16 years of age) staying at 45Lekiu must be accompanied by an adult and must be supervised by an adult at all times.

Parking

Cars and their contents are left at the owner’s/guest’s own risk. We do not accept responsibility for loss or damage.

Guest Behaviour

Guests are requested to conduct themselves appropriately at all times and to comply with Company procedures and/or requests to conduct and respect the property of the Guesthouse, its employees and their health and safety. Guests are not to disrupt the comfort and enjoyment of other guests, the smooth running of the Guesthouse or cause offence to other guests or our members of staff. We reserve the right to refuse accommodation or services or remove you and members of your party from the Guesthouse if, in our reasonable opinion, we consider this provision to have been breached. Where this is the case shall have no obligation to refund you for lost accommodations, other services or any other loss or expense incurred.

Right to Refuse Accommodation

Musang Lena reserves the right to refuse accommodation to any person(s) without any notice and terminate any booking without being liable for any refund or compensation for the following reasons:
– The booking has been paid through fraudulent means.
– The booking has been altered by anyone other than Musang Lena or Musang Lena’s authorized agent has been tampered with or defaced (in which case Musang Lena reserves the right to retain such booking documentation).

Limitation of Liability

Musang Lena is responsible to provide the accommodation according to these Terms and Conditions. We do not accept any liability for failure to provide the service contracted or any due to circumstances beyond our control.

Musang Lena is not in a position to guarantee Guest’s safety against events including but not limited to accidents, death, acts of God, flood, riot, theft or even acts of negligence. All activities have inherent risks to heath and safety and Musang Lena will not be responsible for any eventualities related to any activities or services booked through this website or through any of our agents.

Musang Lena will not be responsible for loss or damage of property left in the Guesthouse during the Guest’s stay.

Privacy and Data Protection

Musang Lena will retain all personal information you provide during booking. By making a booking with us or using the 45Lekiu website, you consent to our use/or disclosure of your personal details to us, to enable or assist us in the provision of services or to exercise or enforce our rights hereunder and/or any other party as Musang Lena may, in our sole and absolute discretion, deem necessary for the following purposes:
– To process you booking and for other administrative purposes.
– To provide customer support and services

We may also be legally obliged to disclose, and you irrevocably consent to our disclosing, your personal information to government and enforcement agencies, regulatory bodies and public authorities or as may be required by law. This may involve sending your personal information between different countries.

We will use our best endeavors to use your personal information in the manner stated herein and will not otherwise disclose your personal information without your prior written consent.

Copyright and Trade Marks

The 45Lekiu website including the booking and other applications, text, graphics, designs, audio and video clips, hotel and destination information and all other content thereon are the property of Musang Lena and /or its content suppliers.

You may use this website and its content solely for personal, non-commercial and private use subject always to applicable copyright laws.

All trademarks, trade names, services marks and all other marks, whether registered or unregistered, on the 45Lekiu website are owned by or licensed to Musang Lena and their respective owners and may not be used, reproduced or modified without the prior written approval of Musang Lena.

Disclaimer

The 45Lekiu website, the services provided and all content thereon are supplied “as is” and “as available”. Musang Lena provides no guarantee regarding the website and content. You are solely responsible for your use thereof.

While we will make every effort to ensure that the information on the 45Lekiu website is accurate and published in good faith, we do not warrant or represent its accuracy and disclaims to the maximum extent permitted by law all warranties expressed or implied by statute, custom or usage.

Musang Lena will not be liable for any direct, indirect, consequential, punitive losses or damage (including without limitation loss of revenue, loss or goodwill, loss of reputation and loss of /or damage to data), arising out of this website or the use thereof, or any errors, inaccuracies or omission in the services or content provided howsoever caused.

Governing Laws

Your contract with Musang Lena is governed by the laws of the country where the 45Lekiu is located and any dispute shall be settled in the courts of that country.

All other matters concerning or relating to the 45Lekiu website shall be governed by the Laws of Malaysia and the Malaysian courts shall have jurisdiction therein.

Changed to these Terms and Conditions

Musang Lena reserves the right to cancel, amend or vary the arrangements and content featured on the 45Lekiu website and/or change or add to these Terms and Conditions at anytime without prior notice

Conflict Between English Text and other Language Text

If there is any conflict or discrepancy between the English text of these Terms and Conditions and any transaction thereof, the English text shall prevail.
